1. General Provisions

1.1. These Terms constitute a legally binding agreement between you ("User", "you") and MB Nordhub regarding your access to and use of the Breach.gg platform (the "Platform").
1.2. By accessing the Platform, you confirm that you are at least 18 years of age or strictly monitored by a legal guardian if you are a minor.
1.3. MB Nordhub reserves the right to modify, update, or delete portions of these Terms at any time without prior notice. Your continued use of the Platform after any changes indicates your acceptance of the new Terms.
1.4. The Platform serves as a robust community portal, news and content aggregator, and a connector between game developers ("Talent") and game studios or employers ("Companies"). We host user-generated content, aggregate third-party news, and facilitate professional networking.

2. Limitation of Liability & No Responsibility

2.1. Platform as an Intermediary & Aggregator: MB Nordhub acts as a venue for Users to exchange information, publish content, and discover industry news. We are not a party to any agreement between Talent and Companies. Furthermore, we aggregate content from third-party sources and do not claim ownership or verified accuracy over such aggregated news.
2.2. No Warranty: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. MB Nordhub makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, materials, or products included on the Platform.
2.3. Data & Content Accuracy: We do not verify the accuracy, completeness, or authenticity of profiles, job postings, user-generated blogs, or aggregated news. You acknowledge that any reliance on such material is at your own risk.
2.4. Content Moderation: We reserve the right, but have no obligation, to monitor, review, edit, remove, or refuse to post any user-generated content or aggregated feed that we, in our sole discretion, determine violates these Terms, our Content Removal Policy, or is otherwise objectionable.
2.5. Limitation of Damages: To the fullest extent permitted by applicable law, MB Nordhub shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) unauthorized access, use, or alteration of your transmissions or content; or (iv) claims of copyright infringement related to user-uploaded or aggregated content.
2.6. Technical Issues: We are not responsible for any technical malfunctions, server downtime, data loss, or security breaches that may occur. We do not guarantee that the Platform will be error-free or uninterrupted.

3. User Accounts and Conduct

3.1. Registration: To access certain features, you must register an account. You agree to provide accurate, current, and complete information during the registration process.
3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
3.3. Prohibited Conduct: You agree not to:

• Use the Platform for any illegal purpose or in violation of any local, state, national, or international law.
• Harass, threaten, demean, or intimidate other users.
• Post inaccurate, misleading, or fraudulent content (e.g., fake job offers or resume data).
• Post, upload, or share content that infringes upon the intellectual property rights, privacy, or other rights of any third party (see our Content Removal Policy).
• Attempt to bypass security measures, scrape data without permission, or interfere with the proper working of the Platform.
• Upload viruses, malware, or other malicious code.

3.4. Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. Intellectual Property Rights

4.1. Our Content: The Platform, including its original content, features, aggregation architecture, and functionality are owned by MB Nordhub and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.2. User Content: By posting content (e.g., blogs, posts, portfolios, job listings) on the Platform, you retain your ownership rights. However, you grant MB Nordhub a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the Platform.
4.3. Third-Party Aggregated Content: Content aggregated from third-party RSS feeds or external websites remains the property of their respective owners. We display such content for informational purposes under fair use principles, linking back to the original source.
4.4. Third-Party Links: The Platform may contain links to third-party websites or services that are not owned or controlled by MB Nordhub. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

5. Indemnification

You agree to defend, indemnify, and hold harmless MB Nordhub, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your User Contributions, any use of the Platform's content, services, and products other than as expressly authorized in these Terms.

6. Governing Law and Dispute Resolution

6.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.
6.2. Jurisdiction: Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts of the Republic of Lithuania.
6.3. Arbitration: At our sole discretion, we may require you to submit any disputes arising from these Terms or use of the Platform, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the Republic of Lithuania applying Lithuanian law.

7. Miscellaneous

7.1. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
7.2. Waiver: No waiver of by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
7.3. Entire Agreement: These Terms constitute the sole and entire agreement between you and MB Nordhub regarding the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.
